TERMS AND CONDITIONS

BY ACCESSING, BROWSING OR PURCHASING FROM JACQUELINEHURST.COM, THELIFECLASS.COM, OR ANY ASSOCIATED SALES PAGES, CHECKOUTS, MEMBER AREAS OR PLATFORMS (INCLUDING KAJABI), YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS.


1. DEFINITIONS

“We”, “us”, “our” refers to Jacqueline Hurst trading as The Life Class, including all associated websites, platforms and delivery systems.

“Sites” refers to jacquelinehurst.com, thelifeclass.com, Kajabi-hosted pages, checkout pages, funnels, member portals, and any other platforms used to deliver Services.

“Services” refers to all digital courses, programmes, memberships, coaching content, live sessions, downloads, recordings, communities and related materials.

“You”, “your”, “user” refers to any customer, purchaser or participant.


2. LEGALLY BINDING AGREEMENT

By completing checkout and/or accessing any Service, you confirm:

  • You have read and understood these Terms in full

  • You agree to be legally bound by them

  • You understand this is a binding digital purchase agreement

  • You are over 18 years of age

  • You have authority to enter into this agreement

Ticking acceptance at checkout constitutes full legal agreement.


3. NATURE OF SERVICES (NO PROFESSIONAL ADVICE)

All Services are for educational and informational purposes only.

They do not constitute:

  • therapy or counselling

  • medical or psychological treatment

  • financial, legal or professional advice

You are solely responsible for your own decisions, actions and results.

No guarantees are made regarding outcomes including emotional wellbeing, relationships, income, business success or personal development.


4. DIGITAL DELIVERY & IMMEDIATE ACCESS (CRITICAL)

All Services are delivered digitally and may include instant or phased access via Kajabi or related platforms.

By purchasing, you expressly request:

  • immediate access to digital content

  • immediate performance of the contract

You acknowledge that once access begins (including login availability), the Service is deemed delivered.


5. STRICT NO REFUND POLICY (ZERO EXCEPTIONS)

ALL PURCHASES ARE FINAL.

Due to the immediate access and digital nature of the Services:

Once access has been granted to any part of the Service (including login access, course materials, downloads, community spaces or live content), no refunds will be issued under any circumstances, including but not limited to:

  • change of mind

  • lack of use or participation

  • failure to complete the programme

  • scheduling conflicts

  • personal or financial circumstances

  • dissatisfaction with content or experience

  • misunderstanding of scope or format

  • failure to attend live sessions

  • payment plan issues

You acknowledge that access = delivery.

Nothing in this clause limits your statutory rights where they cannot legally be excluded.


6. CHARGEBACK & PAYMENT DISPUTE PROTECTION

By purchasing, you agree not to initiate chargebacks or payment disputes without first contacting us in writing to resolve the issue.

If a chargeback or payment dispute is raised:

  • access may be immediately suspended pending investigation

  • all supporting evidence of purchase, access and usage may be submitted to the payment provider

  • you remain liable for the full balance of any agreed payment plan

Unwarranted chargebacks may be treated as breach of contract and pursued accordingly.


7. PAYMENT PLANS (ENFORCED LIABILITY)

If you choose a payment plan:

  • you are entering into an agreement to pay the full course fee

  • all instalments must be paid in full and on time

  • failure to pay will result in immediate suspension of access

  • missed payments do not cancel your contract or financial obligation

We reserve the right to recover outstanding balances via legal or collections processes where necessary.


8. COURSE ACCESS & AVAILABILITY

Access is granted for the period stated at purchase (typically 12 months unless otherwise specified).

We reserve the right to:

  • update, modify or improve content at any time

  • change delivery format or structure

  • remove or replace materials where necessary

Access expiry does not entitle refunds or extensions.


9. COMMUNITY, LIVE CALLS & ENGAGEMENT

Access to communities, group spaces, and live sessions is included at our discretion.

We do not guarantee:

  • attendance at specific times

  • availability of recordings

  • continuity of format or schedule

We reserve the right to remove access for misconduct, abuse, or breach of Terms without refund.


10. CERTIFICATION DISCLAIMER

Any certificate issued is provided by The Life Class only unless otherwise stated.

It is:

  • not a regulated qualification

  • not accredited by a government body

  • not a guarantee of employment, income or business success


11. INTELLECTUAL PROPERTY (STRICT PROTECTION)

All content remains the intellectual property of Jacqueline Hurst / The Life Class.

You are granted a limited, personal, non-transferable licence for your own individual use only.

You may NOT:

  • share login access

  • copy or reproduce content

  • distribute or resell materials

  • teach or repurpose our content

  • record or share sessions

  • use materials commercially

Any breach will result in immediate termination without refund and may result in legal action.


12. USER CONDUCT

You agree not to:

  • misuse or disrupt Services

  • harass, abuse or defame others

  • post inappropriate content in any community

  • violate intellectual property rights

  • use Services for unlawful purposes

We may remove access immediately for breach.


13. TERMINATION

We may suspend or terminate access at any time if:

  • Terms are breached

  • payment fails or is reversed

  • chargeback is initiated

  • abusive behaviour occurs

  • fraud or misuse is suspected

Termination does not cancel outstanding payment obligations.


14. THIRD-PARTY PLATFORMS (KAJABI ETC.)

We use third-party systems including Kajabi, payment processors, email systems and community tools.

We are not responsible for:

  • downtime

  • technical errors

  • access interruptions

  • third-party failures


15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for:

  • loss of income or profit

  • loss of opportunity or business

  • indirect or consequential damages

  • emotional or subjective dissatisfaction

Total liability is limited to the amount paid for the Service.


16. PRIVACY

Your use of Services is also governed by our Privacy Policy.


17. AMENDMENTS

We reserve the right to update these Terms at any time.

Continued use of the Services constitutes acceptance of updated Terms.


18. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

All disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
